30% Withholding on the Minecraft Marketplace: What to Analyze

The Minecraft Marketplace is the catalog where creators and studios sell maps, skins and other content for the game. When a payout arrives with a 30% deduction, the common reaction is to look for a way to reduce it, and opening a company abroad is often the first idea. Before any structure, though, comes a simpler question: what does that percentage represent in your report?

It may be tax withheld at source, the platform's commercial share, or a combination of adjustments. Each has a different origin, rule and consequence. Microsoft itself, in its commercial marketplace documentation, treats the store service fee, taxes on the sale and income tax withholding as separate deductions from the amount paid to the publisher .

This guide separates what the official documentation confirms from what needs to be checked in your contract and in your reports. It does not promise a tax reduction and does not treat the 30% withholding as a rule for every Minecraft Marketplace payout.

Short answer: a US company may help in some scenarios, not automatically

A US company only has a chance of changing the result when three conditions come together. The deduction has to actually be tax withholding and not a commission. The withholding has to depend on who the beneficiary is and which form was submitted. And the gain has to outweigh the cost and the obligations the structure creates in the United States and in Brazil.

If the deduction is the platform's share, opening an LLC does not change it. That is why the first step is to classify the deduction, not to incorporate a company.

Who this guide is for

This text is for studios and creators with an active commercial operation who already sell on the Minecraft Marketplace and receive recurring payouts, directly or through a publisher. It is not a step-by-step guide to filling in forms, nor is it for those who have not sold yet. For anyone just starting out, understanding the contract and the report is worth more than building a structure.

What the 30% deduction means in your Minecraft Marketplace report

A percentage between the gross sales amount and the amount that reaches your account can be one of three things. The table summarizes the differences.

ItemWhat it isWho defines itWhat influences it
Tax withholdingTax collected at source by the payer before the payoutLaw of the source country, the beneficiary's tax documentation and any treatyCountry of residence, type of beneficiary, form, treaty and origin of the sale
Platform commissionPart of the sale that stays with whoever runs the storeProgram contractProgram rules, unrelated to any tax form
Final taxTax actually owed by the recipientLaw of the country of residence and the type of incomeTaxation regime, credits and offsets

Tax withholding

Withholding at source is the tax the payer collects before passing the money on. IRS Publication 515, written for withholding agents, explains that most U.S.-source income received by a foreign person is subject to a 30% tax, and that a lower rate, including an exemption, may apply when there is a treaty between the country of residence and the US .

That 30% is the general rule of a U.S. regulation for U.S.-source income. It only appears in your report if the payment falls under that rule and the payer is required to withhold.

Platform commission

Commission, or the platform's share, is the part of the sale that stays with whoever runs the store. It is a commercial clause of the program contract, not a tax. In Microsoft's commercial marketplace, the store service fee and income tax withholding appear as distinct deductions, each with its own rule.

Final tax

Final tax is what you owe on your income as a whole, and withholding may be only part of that calculation. Under the regime of Law 14.754/2023, which deals with financial investments and with the profits of controlled entities abroad, Brazil's Federal Revenue Service (Receita Federal) allows tax paid abroad to be offset, provided there is an international agreement or reciprocity and up to the limit of the tax due in Brazil on the same income .

Whether that offset applies to revenue from selling digital content is a question of classification, and the percentage taken from the payout does not answer it on its own.

What the official documentation confirms about the Minecraft Marketplace, and what it does not

What Microsoft documents

Microsoft documents withholding in the commercial Microsoft Marketplace, the offer store in Partner Center. On the pages consulted on October 19, 2026:

  • •to sell a paid offer, you must fill in U.S. tax forms: Form W-9 for publishers that meet certain U.S. residency requirements and a W-8 form for all others ;
  • •withholding applies only to sales made to the United States, and sales to other locations are not subject to it;
  • •for most publishers registered outside the US, the default rate is 30%, and rates vary;
  • •the treaty benefit is requested in Part II of Form W-8BEN, and the tax profile documentation determines the rate applied.

These facts describe the commercial marketplace and show how the withholding logic works when a tax profile exists in Partner Center. That is all.

What is not confirmed for the Minecraft Marketplace

The Microsoft pages consulted on payout profile, taxes and reports do not mention Minecraft, Xbox or Mojang. In those documents, therefore, there is no official link between the Minecraft Marketplace and Partner Center, the tax profile or the 30% withholding. The absence from the pages read does not prove the link does not exist, because the creator program's terms may address it in a separate contract.

That is why this guide does not state that:

  • •the 30% deduction on the Minecraft Marketplace is a tax or withholding;
  • •the Minecraft Marketplace follows the commercial marketplace documentation;
  • •the revenue split applies to the gross amount or to the amount net of fees and taxes;
  • •the payout frequency, minimum amount and forms for Minecraft payouts are those of the commercial marketplace.

The answer is in the program contract and in your payout report. Third-party guides that cite percentages disagree with each other and do not replace those documents.

Program, payer and the base subject to withholding on the Minecraft Marketplace

Withholding at source is an obligation of whoever pays, so it matters who pays, from which country, under which program and under which contract. Two creators who sell the same skin may have different reports if one is paid directly by the program and the other through a publisher.

To start identifying the nature of the deduction, check in your report:

  • •the name and country of the paying entity;
  • •whether there is a line for tax withheld, separate from the platform's share;
  • •whether the percentage is the same on every order or varies from one month to another;
  • •whether it changed after you submitted or updated tax documents.

These are clues to investigate, not proof of the nature of the deduction.

There is also the difference between global revenue and the base subject to withholding. In the commercial marketplace, withholding applies only to sales made to the US. If a program had a similar rule, a studio with most of its audience outside the US would have a much smaller base subject to withholding than its total revenue, and the impact of any structure would be proportionally smaller. For the Minecraft Marketplace, that limitation is not confirmed in the documents consulted.

Income classification remains. Publication 515 places royalties from patents and copyrights among the income whose source is the place where the property is used, but it does not say how to classify the sale of digital content on a marketplace, whether as a royalty, a sale of goods or something else. This is one of the questions the diagnosis has to resolve.

What an international structure changes and what it does not

Changing who receives the money can change the beneficiary, the form and the tax treatment. It does not change the program contract, does not alter the platform's commission and does not make the income stop being taxed somewhere.

What the IRS says about foreign-owned LLCs

  • •A single-member LLC is treated as a disregarded entity with respect to its owner, unless it files Form 8832 and elects to be treated as a corporation .
  • •Form W-8BEN is the form for foreign individuals, and a foreign entity uses Form W-8BEN-E. The single owner of a disregarded entity is considered the beneficial owner of the income it receives .
  • •Form W-9 says that a U.S. disregarded entity with a foreign owner must use the appropriate Form W-8, even if the foreign person has a U.S. taxpayer identification number.
  • •A foreign-owned LLC has its own reporting obligation: the Form 5472 instructions call for a pro forma Form 1120 with Form 5472 attached, with a US$25,000 penalty for failure to file .

Treaty between Brazil and the United States

The treaty benefit depends on the country of residence having an income tax treaty with the US. The list of treaties maintained by the IRS, consulted in October 2026, does not include Brazil .

The U.S. Treasury records a tax information exchange agreement with Brazil, signed in 2007 and reported to have entered into force in 2014. Its announcements describe it as an exchange of information and do not say that it reduces the withholding rate. A reduced treaty rate should therefore not be presumed for someone resident in Brazil. Any reduction needs a verified basis.

Why an LLC, an EIN and a US account do not solve it on their own

  • •LLC is the legal form. The tax classification, disregarded or taxed as a corporation, is another layer.
  • •EIN is an identification number. Form W-9, as seen, tells a foreign owner of a disregarded entity to use Form W-8 even with a U.S. number.
  • •US account is where the money lands. It does not change who the beneficiary is or the tax residence of whoever controls the company.

The structure also creates obligations, such as those of Form 5472. If the analysis points to an LLC, the choice of state enters the conversation: see the profiles of Delaware and Wyoming.

How to calculate the net benefit and the break-even point

The calculation that matters is the net result, not the percentage withheld:

net benefit = withholding that stops existing (if it exists and if it is avoidable) − cost of setting up and maintaining the structure − taxes and obligations it creates − accounting and compliance in both countries

Three precautions:

  1. •Cash is not profit. Reducing the deduction on the payout improves the month's cash. If the same income is taxed in another way when it reaches Brazil, the gain may be smaller or nonexistent.
  2. •Better cash flow is not net savings. Only what is left after all costs counts as savings.
  3. •Break-even point is the monthly payout volume from which the benefit covers the cost. Below it, the structure costs more than it helps.

This guide gives no cost figures, because they depend on the jurisdiction, on the providers and on your case. Ask for a written quote before deciding. Obligations in Brazil that continue to exist

Having a company abroad does not take the taxpayer off Brazil's radar. The central points, with the official sources:

  • •A company abroad is lawful, with conditions. According to the Receita Federal, setting up offshore companies is not prohibited by law, provided the funds are remitted under the Central Bank's rules, the declaration of capital abroad is filed when applicable and the company is reported in the income tax return.
  • •Profits of controlled entities. Under Law 14.754/2023, profits of entities controlled abroad by an individual resident in Brazil are taxed at 15%, once a year, on December 31, without depending on distribution, when the entity is in a favored-taxation jurisdiction or has passive income above 40% of total income. The Receita lists royalties among passive income and does not say how to classify revenue from selling digital content to a platform. The data come from the Receita's Q&A in its March 2024 version, and a more recent version may exist.
  • •Declaration of capital abroad. The Central Bank manual states that anyone reaching US$1 million in assets abroad on the December 31 base date files the annual declaration between February 15 and April 5 of the following year, and that filing late exposes the declarant to a fine .
  • •Receiving income as an individual. The Receita states that income from sources located abroad is subject to carnê-leão (the monthly income tax for individuals), with offsetting of tax paid abroad conditioned on an agreement or reciprocity and on a legal limit. The page is from 2023, and the sources read do not say which table or rate applies to each type of foreign income.
  • •2026 changes. Law 15.270/2025 created, from 2026, a 10% withholding on dividends paid by a legal entity to a resident individual above R$50,000 per month, plus a minimum tax for high incomes. The sources read do not settle whether this reaches the profits of a company abroad, and the point goes into the diagnosis.

For the step-by-step of the declaration, see how to declare an offshore company on your income tax return and, for receiving payments from international platforms, US LLC for international payments.

Documents needed for the diagnosis

To classify the deduction and test whether a structure would make a difference, the diagnosis usually starts from:

  • •the contract or terms of the program in which you sell, with any amendments;
  • •recent payout reports, with the deduction lines visible;
  • •identification of the paying entity and of the registered beneficiary;
  • •tax forms already submitted and the profile status, if any;
  • •data on the current company, if there is one, and the tax residence country of the partners.

In the first conversation, do not send passwords or give access to your creator account. Just describe the program and the type of deduction the report shows. The documents come later, through a secure channel.

When the structure may not be worth it

There are scenarios in which the best recommendation, for someone selling on the Minecraft Marketplace, is not to open a company:

  • •the deduction is the platform's commission and not tax withholding;
  • •most sales fall outside the base subject to withholding, where a rule of that kind exists;
  • •the payout volume is too low to cover setup, maintenance and accounting;
  • •the income would still be taxed in Brazil in a way that absorbs the gain;
  • •keeping obligations in two countries does not make sense for your current stage.

Opening a company should not be the mandatory outcome of the diagnosis. In some cases, the result is to understand the contract and carry on as is.

Conclusion

The Minecraft Marketplace can show a 30% deduction for very different reasons, and only the correct classification says whether an international structure deserves analysis. Before opening a company, identify the program, the paying entity and the nature of the deduction, and calculate the net result after all costs and obligations.

Is every 30% deduction on the Minecraft Marketplace a tax

Not necessarily. A 30% deduction in the report may be tax withholding, the platform's commercial share or another adjustment. Withholding is tax collected by the payer, and commission is a clause of the program contract. To know which one applies to you, read the contract and the report, and do not assume from the percentage.

Does the withholding apply to every sale

In Microsoft's commercial marketplace documentation, withholding applies to sales made to the United States, and sales to other locations are not subject to it. For the Minecraft Marketplace, that base rule is not confirmed in the documents consulted and must be checked in your contract.

Does opening an LLC automatically eliminate the deduction

No. If the deduction is the platform's commission, the LLC does not change it. If it is withholding, the effect depends on the beneficiary, on the form and on any treaty. A single-member LLC with a foreign owner is, as a rule, a disregarded entity, and the owner submits Form W-8. The IRS treaty list consulted does not include Brazil, and a foreign-owned LLC has obligations such as Form 5472.

Does having an EIN allow me to submit Form W-9

Not by itself. Form W-9 says that a U.S. disregarded entity with a foreign owner must use the appropriate Form W-8, even if the foreign person has a U.S. identification number. An LLC that elects to be taxed as a corporation fills in Form W-9 as C or S, but that changes the taxation of the company and of the distributions to the foreign owner, and it should be defined with a U.S. accountant beforehand.

Do I need to review my obligations in Brazil

Yes. A company abroad is not prohibited, but the Receita makes its regularity conditional on remitting funds under the Central Bank's rules, filing the declaration of capital abroad when applicable and reporting the company in the income tax return. Profits of controlled entities may be taxed at 15% on December 31, depending on the classification.

Is it possible to recover past withholdings

It depends on the nature of the deduction, the legal basis, the deadline and the procedure. The sources consulted do not state a reimbursement or credit mechanism for U.S.-source royalties, so it is not possible to promise a refund or offset without analyzing the case.

Which documents should I gather

The program contract, payout reports with the deduction lines, identification of the paying entity and of the beneficiary, tax forms submitted and data on the current company. In the first conversation, do not share passwords or account access.
